The suit asks for an injunction against the construction of a water tower designed to hold water to be used for fracking, arguing that it will present a “noise nuisance and traffic hazzards.” The suit relies on zoning restrictions that the plaintiffs believe should protect them against this type of development next to their luxury homes. The complaint says in part that the plaintiffs “Simply want to live in an upscale community free of industrial propertries, tall buildings, and other structures that might devalue their properties and adversely impact the rural lifestyle they sought to enjoy.”
